All You Need to Know About the Texas Compassionate Use Program

Medical marijuana is now legal in the state of Texas for medicinal purposes. The Compassionate Use Act (SB 339), signed by Governor Abbott in 2015, made it legal for patients prescribed a drug that contains “a controlled substance” by a physician to obtain and use low-THC cannabis. This post is here to educate you about the Cannabis Compassion Act and how you can get a prescription. Known as “low-THC cannabis,” this medical marijuana is legal in Texas with a doctor’s prescription.

📌 All You Need to Know About the Texas Compassionate Use Program

On June 25, 2015, Texas Governor Greg Abbott signed Senate Bill 339 into law. This bill legalized low-THC cannabis for a whole slew of medical conditions. But the state issued quotas on how many people could be prescribed low-THC cannabis before it would be removed from their list. In simple terms, the more you have, the longer it will stay on this list. The law treated each patient according to the amount prescribed for them and to whom it was prescribed. It would vary from patient to patient according to the amounts scheduled for them by their physician and who their doctors prescribe them.

📌 What Does Low-Thc Cannabis Look Like?

Low-THC cannabis has a THC content that is lower than average marijuana. The THC content could be as low as 2% or lower, and it can have very little in the way of tetrahydrocannabinol. It is still marijuana, but it is usually much less effective when used for medical purposes. To legally buy low-THC cannabis, you must get a prescription from a licensed physician who will prescribe “a controlled substance” for you. Your physician will recommend what kind of low-THC cannabis you should use and how much of it to use while using the medicine prescribed to you by them. To be prescribed low-THC cannabis, you must meet specific requirements set by the law of Texas. You must be a Texan aged 18 or older and suffer from one of the following conditions:

  • cancer
  • HIV/AIDS
  • glaucoma
  • HIV
  • amyotrophic lateral sclerosis (ALS)
  • Parkinson’s disease
  • multiple sclerosis
  • epilepsy

📌 How Do I Get Medical Cannabis in Texas?

To qualify for a prescription, you must fill out the application form on the Department of Public Safety (DPS) website. Fill out all the relevant fields, including your name and driver’s license number. If you have already been prescribed low-THC cannabis before, they will not need all your information again. Next, upload two front-facing and legible colored photos to the DPS website. You can send color copies of your photo and a copy of your government-issued ID to DPS to expedite your application process. A medical marijuana card Texas is also essential for you to have as well. When you check off that box in the form and upload your photos, you will be added to the list of people who can get medical cannabis by license.

📌 How Long Can I Get Low-THC Cannabis?

Your doctor can prescribe low-THC cannabis no more than twice a year. The total amount you can get is one ounce at a time. It means that you will have the right to use up to 10 times the addiction amount of marijuana in the state of Texas for medical purposes. You can use it for up to 365 days after it has been prescribed. If your doctor writes you a prescription for more than one week’s supply, there is no guarantee that you’ll be able to fill it or that your prescription will be valid within the year. Under no circumstances can a physician prescribe more than two times the recommended daily use amount.

📌 Bottom Line

The Compassionate Use Act was signed into law by Governor Abbott in 2015. It gave patients the right to access low-THC cannabis to treat their medical conditions. Using The Compassionate Use Program will allow Texas residents to get certified and receive a medical marijuana card with which patients can legally purchase medical marijuana products as stated on their prescription.
