Atlanta Officer Who Shot Rayshard Brooks Charged With Murder

The Atlanta police officer who killed 27-year-old Rayshard Brooks by shooting him in the back last week has been charged with murder, Fulton County District Attorney Paul Howard announced Wednesday.

Officer Garret Rolfe, who shot Brooks outside a Wendy’s last week, now faces a charge of felony murder in addition to 10 other charges.

Video of the incident showed police questioning Brooks after he was found sleeping in a car in the Wendy’s drive-thru on Friday, with the 42-minute exchange ending after Brooks resisted arrest following a failed sobriety test, eventually grabbing a Taser from an officer and appearing to aim it at Brooks before the officer returned fire with his gun.

Another officer who tried to detain Brooks has been charged with aggravated assault, and Howard said he will become a cooperating witness for the state.

Brooks’ death came just weeks after George Floyd died in Minneapolis police custody, causing national outrage that led to protests against police brutality around the U.S. and in cities across the world.

The death of Brooks led to renewed unrest in Atlanta, where protesters have spent nights blocking parts of Interstate 75 while the Wendy’s where Brooks was shot outside of has been burned down.

Rolfe had already been fired from the Atlanta Police Department and Police Chief Erika Shields resigned after the shooting.

Protests against police brutality first became widespread following the death of George Floyd on May 25. Many have argued that police could have done a better job with ensuring that the confrontation with Brooks never escalated to the level that it did, and have said there was no need for Rolfe to use lethal force when confronted with a Taser.

Rolfe has previously been the subject of Atlanta Police Department disciplinary investigations, according to records. In six years with the Police Department, Rolfe had 12 incidents reviewed, and on three occasions was subject to disciplinary action. Reuters reports that Rolfe received a written reprimand in October of 2017 for a use-of-force violation involving a firearm. Records also show there was a 2015 incident where Rolfe discharged his weapon, but no action was taken against him.
