Democrats Investigate Whether Trump, DeJoy Violated Laws With USPS Actions

TOPLINE

Various state and national Democratic officials  are investigating whether President Trump’s blocking of U.S.Postal Service funding over mail-in voting and Postmaster General Louis DeJoy’s recent procedural changes to the Postal Service could be illegal under various voter laws.

KEY FACTS

Connecticut Attorney General William Tong accused Trump of trying to hijack the November election in a tweet Friday and said he is “actively engaged in discussion with attorneys general across the nation to mount a vigorous defense of our postal service and the legitimacy of our election.”

Tong later, on CNN Tonight, accused Trump of “intentionally trying to defund the Postal Service and block us from voting” and  “clearly trying to sabotage the election.”

Arizona Secretary of State Katie Hobbs asked the state’s Attorney General Mark Brnovich on Friday to investigate whether the recent changes to the USPS, combined with comments made by Trump about Postal Service funding, violate an Arizona law that makes it a crime to “knowingly delay the delivery of a ballot.”

She also asked the AG to investigate whether by blocking USPS funding the White House had interfered with the state’s constitutional mandate that “all elections be free and equal.”

Rep. Bill Pascrell Jr. (D-N.J.) made a criminal referral to New Jersey Attorney General Gurbir Grewal Friday, asking him to empanel a grand jury to investigate “subversion of election laws by Donald Trump, Louis DeJoy, and other Trump officials in their accelerating arson of the Post Office.”

On Friday New Jersey Gov. Phil Murphy announced the state will largely vote by mail, and Pascrell argued that interference with voting by mail and state elections by the Trump administration may violate New Jersey state laws designed to protect the electoral process.

Key Background

Trump admitted Thursday to holding up a coronavirus stimulus deal over Democrat demands for USPS funding and mail in voting. “They need that money to make the Post Office work so it can take all those millions and millions of ballots,” he said. Without the funding, Trump said, they “can’t have universal mail-in voting because they aren’t equipped to have it,” prompting Democrats to claim Trump is “sabotaging” the election. DeJoy’s newly imposed rules, which include cutting overtime pay and transportation costs, have also drawn severe criticism and slowed the collection and distribution of mail nationwide. In July the Postal Service issued letters to 46 states and Washington D.C. warning their election deadlines could result in ballots being delivered too late to be counted, heightening concerns about how the USPS will handle the November election.
