Trumpworld Likens Lawsuits To Bush Vs. Gore – But Bush Figures Reject The Comparison

Allies of President Trump have sought to boost the credibility of long-shot legal efforts to overcome his election loss by comparing them to the landmark Supreme Court case Bush vs. Gore, but key figures in the Bush administration – including Bush himself – have rejected the comparison and recognized Biden as the victor.

Trump campaign attorney Jenna Ellis and Reps. Clay Higgins (R-La.), Vern Buchanan (R-Fla.) and Jason Smith (R-Mo.) have all cited Bush v. Gore as an example of how protracted legal battles to challenge the results are far from unprecedented – though that decision ultimately ended a recount and resulted in a victory for the apparent winner.

Two Bush vs. Gore lawyers – Gore attorney David Boies and Bush attorney Ted Olson – noted as much in a Washington Post op-ed on Saturday, dismissing comparisons between 2000 and 2020 and stating “Biden will be president… that is the clear outcome.”

The lawyers point out that the electoral college result in 2000 hinged on an “agonizingly close” 537-vote margin in Florida, as opposed to Biden’s leads of over 10,000 in several states putting him over 270 electoral votes.

“The litigation will serve only to delay the inevitable resolution of this year’s presidential election,” Olson and Boies write of Trump’s lawsuits, which haven’t found many sympathetic judicial ears and, where they’ve succeeded, have failed to make any dent in Biden’s margin.

Olson’s fellow Republican Bush vs. Gore attorney Ben Ginsberg concurs, telling PBS there is “not evidence” to back up Trump’s claims of widespread fraud and asserting there “aren’t enough votes involved” in Trump’s absentee ballot case before the Supreme Court to swing the election.

Karl Rove, the Bush’s chief strategist in 2000, wrote in a Wall Street Journal op-ed that Biden’s win “won’t be overturned,” while both of Bush’s secretaries of state, Bush’s brother Jeb Bush (the governor of Florida in 2000) and George W. Bush himself have all acknowledged Biden’s victory.

Chief Critic

In a now-deleted tweet, Rep. Paul Gosar (R-Ariz.), one of Trump’s most fervent allies in Congress, labeled Bush an “expert on stealing elections” after the former president congratulated Biden on winning the election.

Big Number

79%. That’s the share of Americans who believe Biden won the election according to a Reuters/Ipsos poll released last Tuesday. Just 3% said Trump won, while 13% said the election has not been decided.

What To Watch For

While five Republican governors, five senators and ten House members have acknowledged Biden as the winner of the election, the vast majority of Republicans in both chambers have either voiced support for Trump’s legal efforts or stayed silent on the issue. Rep. Denver Riggleman (R-Va.) and Sen. Chris Coons (D-Del.) have both said their Republican colleagues privately accept Biden’s victory, with Coons predicting more will come forward as the inevitable becomes clear.
