Danita Tutt Now: An Update on Her Life & Is She Still in Jail?

The new series on A&E, Accused: Guilty or Innocent? returns on April 28 with its second episode titled “Attempted Murder or Protective Mother?” The show explores the case of Danita Thetford Tutt, a mother from Cleburne, Texas, who was accused in 2016 of attempting to murder her son, Colby Tutt. The prosecution alleged that Tutt injured her son through unnecessary surgeries and then withheld food from him in an attempt to starve him. Tutt denied these allegations, saying that she only followed the recommendations from doctors and hospice workers.

The A&E series explores cases from the perspective of the person accused of a crime through the trial, their defense and their verdict, all seen through the lenses of the defense team and the accused and their family. The show premiered last week with the case of Bryan Steven Lawson, and it explored whether he murdered his wife or killed her in self-defense.

Danita Was Found Guilty & Sentenced to 5 Years in Prison & 10 Years Probation

In October 2018, a Tarrant County jury found Tutt guilty of one count of causing her child serious bodily injury and one count of attempted murder for withholding nutrients and food from her child. The jury deliberated for five days before returning the verdict. A few days later, on October 26, 2018, Tutt was sentenced to five years in prison for injury to a child and a recommended 10 years of probation for attempted murder.

At the time, one of Tutt’s defense attorneys, Terri Moore, said: “She’s devastated. There’s no doubt about it. She’s heartbroken. She’s flat on her face right now. She’s not somebody who has ever given much thought to spending time at the courthouse. Nobody knows the stress of being on trial until it happens to them.” Moore added that the doctors who cared for Colby should shoulder the blame for what happened, for convincing Tutt that her son was terminally ill and dying.

In a recent statement to Heavy, Moore said, “It continues to make me sick to my stomach when I think of Danita. She is an innocent young mother. The jury blew it,” adding that she believes the jury was swayed by the media coverage of the case leading up to the trial that painted Tutt in a negative light.


Danita Is Still in Prison Today & She Is Not Eligible for Parole Until 2021

According to inmate records at the Texas Department of Criminal Justice site, Tutt is sentenced to jail until October 17, 2023. She is serving her sentence in the William P. Hobby Unit, a prison for women in Falls County, Texas. She is eligible for parole on April 18, 2021. According to her record, she was already denied parole on May 25, 2019, due to the nature of the case.

Her offense is listed as injury to a child, dated May 4, 2016. She was sentenced in Tarrant County for five years on October 26, 2018. In an email to Heavy, Moore said, “Danita is a strong woman deeply committed to her faith. She is using her faith to help other incarcerated women know they can lean on that faith to give them strength.” She added that an appeal has been filed but there has not yet been a decision.

She said, “it’s heartbreaking that she has to be away from her kids and her son continues to have the same health issues that he [had] before Danita was convicted.”

  1. I stand with Danita. She was told Colby was terminal. Told that was only going to be kept comfortable. With his digestive issues and colon problems who would force a dying child to eat and wind up in more pain. If the hospice folks were convinced he was malnourished as Connie stated, why was Colby not on a feeding tube. This case smells fishy to me. Dr Jamey Coffman is just looking for more cases and coverage to boost her claim of “expertise”.

  2. I blame this Connie at Ronald McDonald House and Dr. Jayme Coffman. I think thatDr Jayme Coffman is a quack and likes the attention she gets from being on tv and sending mothers to prison wether they’re innocent or guilty. Look what she did to Danita Tutt. Karma will come back to people like her and Connie. Also these doctors who said they did unnecessary surgeries because of her. I would hate to bring my child to them if they can be manipulated. Who is the doctor her? Them or the mother?

    • I was thinking that Dr. Jayme Coffman has the doctor version of Munchausen. She can’t find enough people to study or make her specialty relevant so she creates them.

    • No kidding. How can you “make” a surgeon do a surgery? Also obviously the last one performed at Cook, the drs screwed up and caused Colby to become septic. That’s why they CTA with the terminal diagnosis. They should of been on trial, not the mom. I am so glad she is out in a few months. God has kept her strong.

  3. I absolutely stand with Danita. This is ridiculous and devastatingly horrendous. As both, a mother of 1 son with Autism and a younger son with another mental illness, as well as being a Medical Professional, I can not believe that this case ever saw the light of day. EXCEPT for the fact that I know first hand how messed up the medical field can be these days. I believe that Dr. Jamey Coffman (not much of a Doctor and a disgrace to the profession) is the real attention seeker & liar, as well as Connie (another disgrace) BOTH need to have whatever Licenses they hold TAKEN AWAY and they need to be charged with how they have ruined these children’s lives, Danita’s life, Her husband’s life and her families! Defamation of Character, Slander, Lying under Oath, Undue Distress, you name it! LET DANITA GO HOME TO THOSE BABIES THAT NEED THEIR MOMMA!!! LOCK UP THE LYING, ATTENTION SEEKING B!(“=$ !!!

  4. Eta: as well as how broken and ruined our justice system is these days. There are FAR TOO MANY innocent people sitting in prison and EVEN FAR MORE guilty people walking free.

  5. My heart goes out to Danita! I can’t even imagine going through everything she’s been through and continues to go through. Raising a child with serious medical issues would be hard enough, to have a “Connie” come into your life to totally assassinate you as a Mother would be so hurtful, but then to have criminal charges filed against you of such serious charges all because of a lying “Connie” would be DEVASTATING! Danita has NOT had a fair chance. I totally believe in her innocence! I truly hope she’s let out early in a couple months! To the Justice System – This is wrong! To the jurors: You guys really got the verdict wrong!

  6. I can’t believe what has happened here to an innocent mother, to much enthuse is put on these so called doctors and they are never wrong!! When at the end of the day they are just a human beings and can form a opinion of someone which is totally incorrect and because of these two alleged professionals they have ruined so many lives. It really saddens me the way the law can get it so wrong not just now and again but regularly.

  7. My thoughts and prayers are with The Tutt family. There just has to be more to this than what their saying. You even as a parent can’t just wonder into a doctors office and say “my child needs this surgery” and the doctors just do it, no questions asked! That’s not how this works.. The doctors should preform test and health screens. Not just do what mom says! There’s something missing here!

  8. Danita Tutt is innocent! It shows the jury is not always mature enough to be selected and the state should not have even brought this case to trial. My heart breaks for the family, truly it does. I have learned not to always believe what doctors say. I will always have several options before anything is decided. Shame on Texas!!!

  9. I maybe the first one to say that she is exactly where she belongs. She craved the attention, and milked every appointment, surgery, consultation, ER visit, blood transfusion and every other procedure that innocent child endured at that sick woman’s hands all while she posted every single detail to Facebook. So that she could get as much attention and that high she craved from being the center of attention. She tried to kill him because that would be the ultimate ending to her never ending sap story. She relished the attention and bathed in the notoriety it gave her in her “support groups”. I do not feel sorry her in slightest. My heart breaks for her sons and her innocent husband and their extended family. Her dad wouldn’t have noticed anything she did wrong. She is the apple of his eye. And he absolutely would have done ANYTHING to save her. I’m sorry y’all are so fooled by her fake crying and horrible shoulder shaking that you believe her lies. With all that said, I must also say I feel that Connie lady is a horrible person as well as that Dr. Jayme Coffman. This whole situation is full of bad people. I’m sorry the other two haven’t faced justice yet. Their day is coming soon.

    • Wow, there’s idiotic comments and then theres your reply. Maybe notice that the kid died later in 2020, while she was in prison, because of the same issues. She should have been released as soon as that happened.

      • Exactly right! She should have been released as soon as her son died. Lots of dr’s are liars. If you even question one thing most dr’s will throw a tantrum, all of a sudden now these dr’s were listening to the mother? Anyone with sense knows this is a huge lie! She knew her son was dying and sensed it, she wanted to do everything she could, and to vent is a normal rational thing. If you hold all the stress of the situation and not vent on Facebook she would become unhealthy and not be able to care for her son properly! This was a disgrace of justice all the way around! And in the end, the truth came out her son oast of the exact things she was posting about and worried about. These people should be ashamed of themselves! Of course, they are not, I’m sure they are prideful and unrepentant! Sad

    • Wow!! There is NO WAY IN HELL your a momma!! It dont take a genius to see the hospice nurse had to “know” the judge or some of the jurers cause ANYONE could follow this and see the hospice nurse had things to cover up. This poor family!! The freakin system is so broken and COMPLETLY failed this family. I wouldnt quit fighting this! This freakin system would have to pay millions to me and my family for what has happened. It wouldnt bring Colby back, it wouldnt give Donita her lost freedom back but all involved should never get by forever with this! God help you for this rediculas comment….every word of it.!

    • Michelle, I hope you never have to face a similar situation. This was definitely a situation that went too far. Very unjust!
      Professionals should have lost their license.
      It’s hard to believe the state ever allowed this.
      Too many professionals needing validation.
      I for one will not give to the Ronald McDonald house again. Connie just threw an innocent under the bus to save her own ass.

  10. The hospital covered up their bad care and malpractice by seeking the mother first before she could accuse them. Thats about it.

  11. I too believe that Danita is 💯% innocent. Danita should have been able to take the stand. She was willing and passionate about wanting to tell the jury how she loved and cared for son. As parents of a disabled son she was at the mercy of medical professionals to refer treatment and surgery. That is true for anyone. Danita has my deepest sympathy and my most sincere prayers. God is with you Danita even in your darkest days.

  12. I believe this woman to be 1000% innocent & believe this should be overturned by the courts. It’s scary to think that your children could be taken away & a parent put in jail because they followed the advice of the doctors & caregivers. The state of TX should be ashamed of themselves for allowing this innocent woman to be in jail on bs charges & a kangaroo court case. I’m absolutely disgusted by this & have lost all faith in the legal system of the United States. I’ve seen so many unfair things go on in the US that I’m ashamed to be a citizen. But I’m also 1/2 Native American & I know how unfair the US truly can be.
