Bar Owners Sue Texas Governor To Reverse Order To Close Again

Texas bar owners are suing Gov. Greg Abbott to block an order he issued last week requiring them to shut down as part of a rollback of the state’s reopening in the face of a worsening coronavirus outbreak.

About two dozen bar owners and private citizens have reportedly signed on to the lawsuit, according to the Austin American-Statesman, demanding that Abbott and the state allow bars to remain open, claiming that his emergency order is unconstitutional.

Despite an earlier reluctance to do so, Abbott ordered the reversal of some reopening measures last week, ordering bars to close and lowering restaurant capacity back down to 50%, instead of the 75% it was allowed at for much of June.

Abbott has said he regretted how fast he allowed bars to reopen, which he stated has contributed to the record increase in coronavirus cases and hospitalizations over the past two weeks.

The lawsuit says that Abbott unfairly singled out bars, allowing businesses like barber shops and nail salons to stay open, while also claiming he overstepped his authority by suspending state laws, which is a power reserved for the state legislature.

The lawsuit was filed in Travis County District Court by Houston-based attorney Jared Woodfill, the former longtime chairman of the Harris County Republican Party.

Woodfill is also the attorney representing hundreds of plaintiffs in another lawsuit challenging the governor’s earlier executive orders.

Texas was largely spared the serious effects some parts of the U.S. saw from the first major coronavirus spike in March and April, making officials there eager to start reopening the state’s economy when allowed to do so at the end of April. The state reopened businesses quickly, with bars allowed to reopen starting May 22. Since that time, though, coronavirus cases have consistently risen, and the 7-day rolling average for new cases is now above 5,000 per day. The state again set a hospitalization record on Monday after Sunday broke a streak of 16 straight days of record high hospitalizations. Abbott has recently pleaded with residents to wear masks and follow social distancing guidelines.

While the handful of bar owners may be asking the state to continue reopening, local officials from the state’s largest cities are asking Abbott for the authority to reinstate stay-at-home orders, amid concerns health care systems might soon be overwhelmed.
