Ousted U.S. Attorney Is ‘Sure’ To Testify Before Congress, Committee Chairman Says

Geoffrey Berman, the Justice Department official who investigated allies of President Donald Trump before being controversially ousted from his post as U.S. Attorney for the Southern District of New York, is “sure” to testify before Congress, the House Judiciary Committee Chairman said Sunday—likely bringing light to contradicting stories about why he left the job.

Berman, who prosecuted Trump’s former attorney Michael Cohen and brought a grand jury indictment against associates of current Trump attorney Rudy Giuliani, officially left his post on Saturday.

On Friday night, Barr said that Berman had agreed to step down from his position, to which Berman responded by saying he had “no intention of resigning,” adding that he had only learned of his own resignation through news reports.

Saturday brought even more confusion about why Berman was leaving; Barr said in a letter to Berman on Saturday that Trump ordered his firing, but the president subsequently told reporters that it was Barr’s decision and “I’m not involved.”

Berman later accepted that he would be removed from the position after Barr confirmed that Audrey Strauss, the Deputy U.S. Attorney for the district, would fill in for Berman—not Craig Carpenito, the U.S. Attorney for the District of New Jersey who Barr initially said would replace Berman, though the legal authority of that move was questioned.

Berman’s departure and the public spectacle that followed it brought serious criticism from top Democrats, with Rep. Jerry Nadler—the head of the House Judiciary Committee—saying he would “immediately open an investigation into this incident, as part of our broader investigation into Barr’s unacceptable politicization of the Department of Justice.”

“I don’t know about Wednesday, but I’m sure he will testify,” Nadler said Sunday on CNN’s “State of the Union.”

Wednesday is when Justice Department whistleblowers are scheduled to testify before the Committee.

KEY BACKGROUND

Berman and Trump reportedly had a rocky relationship for essentially the entire time Berman served in his role, even though it was Trump’s original Attorney General—Jeff Sessions—who picked Berman for the job after Trump fired Preet Bharara. But Berman was picked in an interim role, and officially appointed by a federal court. He was never actually appointed by Trump and confirmed by the Senate, which some legal experts say meant Trump didn’t have legal authority to officially fire Berman.

The Southern District of New York, which includes Manhattan, is widely considered as the most powerful and prestigious federal judicial district in the U.S.
